NIGHT SHIFT DIFFERENTIAL PAY IN THE PHILIPPINES


Most of the BPO companies in the Philippines operate on a night to day basis instead of the usual 8 am to 5 pm. This working hours helps the company to be in real time communication with their clients, investors, or headquarters on the other side of the world.


While working on a night shift has its own benefit, employees working on this shift tend to sacrifice a good night’s sleep and basically, a normal morning routine.


With this, the government mandates the additional compensation of 10% of an employee’s regular wage for each hour of work performed between 10 pm and 6 am. Note that employers can make the NSD percentage higher than the one provided by law.


All employees are entitled to overtime pay except the following employees but may be entitled to the same or similar benefits if so provided under an employment contract:


  1. Government employees

  2. Those of retail and service establishments regularly employing less than 5 employees

  3. Kasambahay and persons in the personal service of another

  4. Managerial employees

  5. Officers or members of a managerial staff

  6. Field personnel and those whose time and performance are unsupervised by the employer
